Dispute Resolution & Arbitration

The section below titled “Dispute Resolution & Arbitration” requires you to arbitrate claims you may have against Frontline Solar (“Frontline Solar” or “we”), meaning you cannot bring claims against Frontline Solar in court. It also includes a class action waiver in arbitration. This affects your legal rights, so please read it carefully.

Welcome to frontlinesolar.com. These Terms of Service (the “Terms”) are a binding legal agreement between you and Frontline Solar regarding your use of our websites (including www.frontlinesolar.com), our mobile applications, and the solar energy services we provide (the website, mobile apps, and services collectively referred to as the “Service”). Please read these Terms carefully.

When you use certain features of our Service such as downloadable tools, solar estimation calculators, or financing applications—you may also be subject to additional guidelines, terms, or agreements specific to those features (“Policies”). All such Policies are incorporated by reference into these Terms. If there is any conflict between these Terms and a Policy, the Policy will govern for that feature.

Frontline Solar may update these Terms from time to time. By accessing or using our Service or installing any application, you agree to the current Terms and any updates we make. It is your responsibility to review these Terms regularly to stay informed about changes. Continuing to use the Service after changes are made means you accept the revised Terms. If you do not agree with any part of these Terms, you must not use our Service.

The Service

Frontline Solar offers homeowners in South and Central Texas a convenient and cost-effective way to switch to solar energy. Homeowners can request free quotes for residential solar solutions. For projects that require specialized installation, Frontline Solar may partner with leading PV installation companies to ensure your system is installed safely and efficiently. We monitor your system’s performance, provide comprehensive insurance coverage, and offer a performance-backed satisfaction guarantee. Through our Service, customers can manage payments, track their solar system’s output, and access a variety of tools to optimize their solar energy experience.

Eligibility

 To use Frontline Solar’s services, you must be at least 18 years old. Use of our services is not allowed where prohibited by law. By using our Service, you confirm that all information you provide is accurate and truthful, that you are legally capable of entering into these Terms, and that you understand the Service is not intended for individuals under 18 years of age.

Registration

If you have entered into a Solar Power Purchase Agreement or Lease Agreement with Frontline Solar (“Frontline Solar Customer”), you must create an online account to access certain features of the Service. During registration, you may need to provide billing or other information. By registering, you agree to:
(a) Provide complete, accurate, and up-to-date information as requested in our registration forms (“Registration Data”);
(b) Protect the security of any login credentials, passwords, or other account information; and
(c) Keep your Registration Data and all account information current and accurate, and notify us immediately of any unauthorized use of your account or security breach by contacting us at support@frontline-solar.com.

Payments by Frontline Solar Customers

With Frontline Solar, you can conveniently pay your invoices online, including monthly lease payments or charges based on your solar energy production whether estimated or actual. Frontline Solar may adjust fees for certain services at any time, with notice provided via our Service or other communication channels.

By using our Service to pay invoices, you authorize Frontline Solar or its trusted payment partners to charge the credit card, debit card, or bank account you provide (which you confirm you are authorized to use) for the invoice amount in US dollars, including any applicable taxes. If you opt for recurring payments, your selected payment method will be automatically charged each cycle. To stop recurring payments, you must cancel at least 7 days before the next scheduled payment by contacting us at customercare@frontlinesolar.com.

If a payment cannot be processed, you agree to settle all outstanding amounts promptly, and Frontline Solar may temporarily suspend access to the Service until payment is received, alongside any other rights available under your Service Agreement. We also reserve the right to correct any errors in billing, even after a payment has been processed.

You are responsible for any fees your bank, card issuer, or financial institution may charge, including overdraft, insufficient funds, or over-limit fees. Any billing discrepancies must be reported within 90 days of appearing on your statement, or you waive the right to dispute them. All payments made are final, and refunds are not provided.

Promotions

From time to time, Frontline Solar may share special offers or promotions with you via email or through our Service, including offers from third parties. Promotions may change, expire, or be withdrawn without prior notice. We cannot guarantee the legality of third-party promotions or their ability to fulfill offers.

Use of Data

Frontline Solar provides tools to help you track your solar energy system’s performance, including usage statistics, projections, and monthly energy production summaries (“Data”). While this data reflects how your system is performing, it may not be used directly to calculate your monthly invoices, and some information may not appear in real time.

The Data provided is for informational purposes only. While we strive to ensure accuracy, Frontline Solar does not guarantee it, and we are not responsible for decisions made based on this Data. Rest assured, no mobile opt-in or personal information is shared with third parties for marketing purposes.

Credit Evaluation Tool

At Frontline Solar, we may offer you the option to check your credit through a trusted third-party tool (“Credit Evaluation Tool”). To use this tool, you will need to provide certain personal and financial details. By using this tool, you give Frontline Solar permission to review your credit report to help determine eligibility for specific features or programs within our solar services.

Usage Guidelines

When using our services, you agree not to:

  1. Use the service for commercial purposes unless explicitly authorized by a separate agreement with Frontline Solar.
  2. Harass, stalk, or intimidate any person in any way.
  3. Access, collect, or copy data from our services using automated tools like robots, scrapers, or manual methods without written permission.
  4. Circumvent security measures or restrictions designed to protect the service.
  5. Place an unreasonable or excessive load on our systems.
  6. Incorporate any part of our services into another website without prior written consent.
  7. Violate any local, state, federal, or international laws or regulations.

Interactive Features

Our platform may include interactive tools such as forums, message boards, reviews, social networking features, or other content-sharing options (“Interactive Features”). When using these features, you are responsible for your own actions and content. By participating, you agree not to post or share:

  • Content that is unlawful, defamatory, obscene, pornographic, harassing, threatening, or otherwise harmful.
  • Material that infringes on the rights of others, including copyrights, trademarks, or trade secrets.
  • Private or sensitive information about anyone without permission, or content that impersonates others.
  • Advertising, solicitations, or political campaigning, except where explicitly allowed.
  • Comments referencing minors under 18 years of age.
  • Malware, viruses, or any harmful software.
  • Any material that could limit others from using the services safely or may expose Frontline Solar or its users to risk.

By using our Interactive Features, you acknowledge that all activity is at your own risk and agree to follow these guidelines to maintain a safe and respectful community.

Material Submission and Use

Any content you submit or upload to public areas of Frontline Solar’s website or services—such as photos, comments, or documents may be visible to others. If you prefer that your content remains private, please refrain from uploading it to public or shared areas.

Frontline Solar does not assume responsibility or liability for any content posted, stored, or uploaded by you or any third party. While we are not required to monitor or edit submitted content, we reserve the right to remove, review, or edit any content at our sole discretion, at any time and for any reason, without prior notice.

By posting content on our service, you grant Frontline Solar, its affiliates, and subsidiaries a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, modify, distribute, and display your content in any media. You also confirm that you have full ownership or authorization to post the material, and that posting it does not infringe on the rights of others or create liability for Frontline Solar or third parties.

Additionally, you acknowledge that Frontline Solar may retain profile information, photos, and other content (“Content”) and may disclose such Content when required by law, to enforce our Terms, to respond to claims regarding third-party rights, or to protect the rights, safety, and property of Frontline Solar, our users, or the public, in line with our Privacy Policy.

Service Modifications

Frontline Solar reserves the right to modify, suspend, or discontinue, temporarily or permanently, any part of our services without notice. We, along with our partners or service providers, will not be liable for any changes, interruptions, or limitations to the service.

Account Termination

Your account with Frontline Solar remains active unless you cancel it or we terminate it under these Terms. To cancel your online account, please email us at customercare@frontlinesolar.com. Please note that cancelling your account does not affect any signed Solar Power Purchase Agreement or Lease Agreement. Frontline Solar reserves the right, at its sole discretion and without prior notice, to terminate accounts or restrict access to the service.

Feedback

At Frontline Solar, we welcome your ideas, suggestions, comments, or any other information you share with us (“Feedback”). By submitting Feedback via email or other channels, you agree that it is non-confidential. You grant Frontline Solar and its affiliates a worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, copy, modify, or distribute your Feedback for any purpose, without any obligation to provide compensation or attribution to you.

Copyright and Intellectual Property

Frontline Solar respects the intellectual property rights of others and expects our users to do the same. We reserve the right to suspend or terminate access to our services for users who infringe on copyright or other intellectual property rights.

If you believe that your copyrighted work has been posted on our website or other services in a way that violates your rights, please contact us with the following information:

  1. Your physical or electronic signature.
  2. A description of the copyrighted work you claim is being infringed.
  3. The exact location(s) on our website or services where the material appears.
  4. Your contact information, including address, phone number, and email.
  5. A statement that you have a good faith belief that the use of the material is unauthorized.

  5. A statement consenting to the jurisdiction of the federal court in Texas and agreeing to accept service of process from the original complaining party.

Upon receipt of a valid counter-notice, Frontline Solar may notify the original complainant and, unless legal action is taken, may restore access to the content within 10–14 business days at our discretion.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER Frontline Solar NOR ITS SUPPLIERS OR PARTNERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF Frontline Solar OR ITS PARTNERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO ACCESS OR USE, OUR SERVICES OR CONTENT. SOME STATES OR JURISDICTIONS MAY NOT ALLOW LIMITATIONS ON CERTAIN TYPES OF DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF Frontline Solar AND ITS SUPPLIERS OR PARTNERS TO YOU UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). Consent to Electronic Communications

By using Frontline Solar’s services, you agree to receive electronic communications from us. This may include account notices, updates about services, or other information related to your relationship with us. You consent that these communications satisfy any legal requirement for written notice.

General Legal Notices

If we do not enforce a provision in any instance, it does not waive our right to enforce it in other circumstances. If any part of these Terms is found to be invalid or unenforceable, the remainder will remain in full effect. Section titles are for convenience only and do not carry legal weight. Provisions meant to survive termination such as indemnification, liability limits, disclaimers, and intellectual property rights will continue after termination. These Terms, together with our policies, represent the full agreement between you and Frontline Solar and replace any prior agreements regarding the same subject.

Dispute Resolution & Arbitration

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute or claim arising out of or relating to these Terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place instead of court proceedings, and both parties waive the right to a trial by jury. Arbitration will be conducted individually; class arbitrations or class actions are not permitted.

The arbitration will take place in Texas (or another mutually agreed location in South or Central Texas). The arbitrator’s decision is final and binding, with limited rights of appeal as allowed under Texas law. Either party may seek temporary or preliminary court relief to protect their rights while arbitration is pending. Nothing in these Terms prevents you from contacting federal, state, or local agencies if permitted by law.
